At Hoveroo, the safety of children and the wellbeing of families are central to everything we do. We take our responsibilities to Queensland families seriously and are committed to acting transparently and in compliance with Queensland law.

 

We are therefore writing to inform you of a Queensland-wide product recall relating to the Elektra Junior Kids Electric Scooter that you purchased from us. We appreciate that recall notices can be concerning, and we want to clearly explain what this recall means and the options available to you.

why is this recall being conducted?

This recall is not being conducted due to any identified defect or malfunction with the product itself. Rather, it relates to how the product is classified and regulated for use in public areas under Queensland law.

 

Electric scooters are regulated under Queensland law, with specific rules applying to their use in public areas. This recall is being conducted to ensure that families are clearly informed about those rules and that our products are supplied and used in accordance with State requirements.

what is the issue?

In Queensland, electric ‘toy’ scooters used by children under 16 years old in public areas — such as footpaths, roads, shared paths, bike paths, parks, and other public spaces — must be incapable of exceeding 10 km/h when propelled by the motor.

 

The Elektra Junior Kids Electric Scooter is capable of travelling at speeds of up to 16 km/h when motor-propelled. As a result, it is not deemed a ‘toy’ scooter and does not meet Queensland requirements for use in public areas by children under 16 years old. This regulatory classification issue is the reason for the recall.

what about use on private property?

When used sensibly and responsibly on private property, such as at home, on farms, in backyards, long driveways, grassy areas, courtyards, or simply around the house — including on a bull-nose veranda or under a traditional Queenslander home — the scooter may continue to be enjoyed as intended and does not raise any issue under
Queensland road or transport laws.

 

We reiterate, this recall is not being conducted due to any identified defect or malfunction with the product itself. Rather, it relates to how the product is classified and regulated for use in public areas under Queensland law.

what should you do?

If you purchased your Elektra Junior Kids Electric Scooter from Hoveroo for the sole purpose of riding it in public areas, we strongly encourage all Queensland customers to carefully consider participating in this recall, as the scooter does not meet Queensland requirements for use in public areas.

 

If you purchased your Elektra Junior Kids Electric Scooter for the purpose of riding on private property only, then you may disregard this product recall.

 

If you purchased your Elektra Junior Kids Electric Scooter for the purpose of riding it in both public areas and on private property, we hereby provide formal notice that the scooter does not meet Queensland requirements for use in public areas, and so you must only ride it on private property, and if this is not possible, then we strongly encourage all
Queensland customers to carefully consider participating in this recall.

your rights under australian consumer law

Under Australian Consumer Law, in the context of this Queensland recall, consumers are entitled to remedies, which may include:
✔️ a replacement product; or
✔️ a full refund.

 

In this case, presently there is no like-for-like replacement scooter in our range that meets Queensland public-area requirements. For that reason, we are offering the following options in lieu of a replacement scooter, so that you can choose what works best for your family.

Important: This option is available for customers who participate within 30 days of the date of this notice. After that period, the available options will be the refund or store voucher.

how to participate in the recall

To receive one of the recall options listed above, the scooter will need to be returned to us.


Once we receive the returned scooter, we will promptly process your selected option (exchange, voucher, or refund).

how to return the scooter (simple and flexible options)

We understand that the scooter is a larger item and that finding suitable packaging may not always be easy. Return shipping is Reply Paid via Australia Post, meaning postage is free. You may return the scooter using any of the following packaging options:

  • placing it in a cardboard box, if available;
  • wrapping it securely in bubble wrap and tape;
  • wrapping it in a heavy-duty garbage bag, secured with tape;
  • wrapping it in an old towel, blanket, or similar protective material, taped securely; or
  • purchasing a box or packaging materials from Australia Post, which are available in-store.


The key requirement is that the scooter is securely wrapped for safe handling during transit.


While the cost of packaging materials is the customer’s responsibility, this is accounted for in the value of the recall options, particularly Option 1 (the exchange option).


Once packaged, simply attach the Reply Paid return label we provide and lodge the item at your nearest Australia Post outlet.

We will be running this Queensland recall campaign for 90 days from the date of this notice to help us manage returns and process remedies as smoothly as possible.
